Responsibility for the payment of travel and related expenses, together with witness fees, for witnesses subpoenaed by an indigent defendant is the question raised in this appeal. The public defender, by motion, requested that these expenses be paid by Laramie County, but the district court refused to impose this expense upon the county, ruling instead that these expenses should be paid by the office of the public defender. The ruling of the district court was premised in part upon the fact that a state district attorneys office exists in Laramie County. We conclude that the requirement for payment of the expenses of witnesses subpoenaed for indigent defendants should have a uniform application statewide; those expenses should be borne by the counties; and the order of the district court is reversed with direction that the county be ordered to pay these expenses.
