Appellant Loram Maintenance of Way, Inc. (ALoram") appeals from a judgment in which the jury found in favor of Appellee David Ianni in his negligence suit. On appeal, Loram asserts that, as a matter of law, it owed no duty of care to Mr. Ianni and challenges the legal and factual sufficiency of the evidence to support the jury's findings of proximate cause and gross negligence or liability for punitive damages. We affirm.
